ITIN Mortgage Loans in Miami: Buying a Home Without a Social Security Number

About 1.49 million Miami-Dade residents were born outside the United States, which works out to 54.5 percent of the county, according to U.S. Census Bureau American Community Survey five-year estimates released in 2024. A large share of those households pay federal income tax under an Individual Taxpayer Identification Number instead of a Social Security number. Almost all of them have been told, by someone who sounded confident, that they cannot buy a house.

The ITIN is rarely what kills the loan. Documented lawful presence is.

That distinction is not a technicality. It determines which lenders can fund your purchase, how much you need to put down, and if the price you get quoted is fair or invented. Most of what is written about ITIN loans online collapses two separate rules into one wrong sentence, and buyers pay for the confusion.

What an ITIN Actually Is

The IRS issues an ITIN to people who have a federal tax filing obligation but are not eligible for a Social Security number. You apply on Form W-7. It is a tax processing number and nothing else. It does not grant work authorization, it does not confer any immigration status, and it does not make you eligible for Social Security benefits.

One detail catches people every year. An ITIN expires on December 31 of the third consecutive tax year it does not appear on a federal return. Someone who filed in 2021 and 2022, then stopped filing, may be holding a dead number without knowing it. Renewal costs nothing, but you file Form W-7 again with original or certified identity documents and the IRS suggests allowing about seven weeks. During filing season, or if you file from abroad, it runs nine to eleven.

Check this first, not later. An expired ITIN surfacing on day 12 of a 15-day financing contingency is a problem your lender cannot solve. Verify the number is current before you write an offer, and if it is stale, renew it and shop after the IRS confirms.

The volume here is not marginal. Over two million federal returns were filed by ITIN primary filers in tax year 2019, roughly 1.6 percent of all individual returns, according to IRS data compiled by the Institute on Taxation and Economic Policy. South Florida holds a disproportionate share of them.

Fannie Mae's guide has said "Social Security number or ITIN" for years. Almost nobody reads the next section.

Selling Guide B2-2-01, effective September 3, 2025, states plainly that Fannie Mae requires each borrower to have a valid Social Security number or Individual Taxpayer Identification Number. So the flat claim that conventional financing bars ITIN holders is wrong as written. The barrier lives in B2-2-02, which conditions eligibility on lawful residency status. Two different requirements, and only one of them is about the number.

Why does the difference matter to you? Because a borrower who holds an ITIN and documented lawful presence, which describes a lot of visa holders and people with pending status, may have a conventional option that a loan officer working from folklore will never quote. Ask to be checked against the actual guide.

The overlay problem

Individual lenders are free to be stricter than the agencies, and many are. A shop can require a Social Security number on every file even where the guide permits an ITIN, usually because their operations team does not want to underwrite the exception. That is a business decision, not a rule, and it is a good reason to get quotes from more than one place.

FHA Got Harder in 2025

FHA has always required a Social Security number and has never accepted an ITIN in its place. What changed last year is who qualifies at all.

Mortgagee Letter 2025-09 removed non-permanent residents from eligibility across FHA Title II programs for case numbers assigned on or after May 25, 2025. That sweep covers purchase loans, 203(k) rehab financing, streamline refinances and reverse mortgages. Eligibility now runs to U.S. citizens, lawful permanent residents, and citizens of the Federated States of Micronesia, the Republic of the Marshall Islands and the Republic of Palau. Lenders must document permanent status through USCIS records, and a Social Security card no longer establishes it on its own.

So What Is an ITIN Loan?

It is a portfolio product. The lender either keeps the loan on its own books or sells it to a private investor with its own appetite, which is why terms swing so much between shops. There is no rulebook to point at, which cuts both ways: no rigid disqualifier, and no standard pricing either.

What tends to hold across programs:

  • Fifteen to twenty-five percent down, with the low end reserved for strong, well-documented files
  • Two years of filed federal returns carrying the ITIN, which is also the proof your number is live
  • Income documented the ordinary way, through pay stubs and W-2s, or through bank statements if you work for yourself
  • Reserves after closing, counted in months of principal, interest, taxes, insurance and association dues
  • Primary residence in most cases, since these programs are built for owner occupants

Self-employed applicants often land in the same place twice, because ITIN files and self-employment files both leave the agency lane. If you own a business, read the bank statement loan guide and the self-employed mortgage guide next, since the qualifying math there usually carries over directly.

Because there is no standard sheet, comparing offers matters more here than on an agency loan. Two lenders can be twenty percent apart on required down payment for the same borrower. That is not something you find out by asking one of them.

The Credit File Problem, and How to Fix It Before You Apply

Plenty of ITIN applicants have no score at all. That is not a rejection, but it does mean the file gets built by hand.

Underwriters assemble a nontraditional credit history from twelve months of payments you can prove: rent, electricity, water, cell phone, auto insurance, childcare, tuition. Underwriters typically want several such accounts, not just one. The Miami version of this problem is specific and it is worth naming, because it wrecks more files than low income does. Utilities are frequently in a spouse, sibling or landlord name. Rent gets paid in cash. Neither one builds anything for the person who actually needs the history.

A payment history that is not in your name is a payment history for someone else.

Fix it a year ahead of shopping. Move at least two utilities into your own name. Pay rent by check, Zelle or bank transfer so there is a traceable record, and keep the bank statements. A verification of rent signed by a property management company counts for far more than a handwritten letter from an individual landlord, because underwriters know how easy the second one is to produce. Ability to Repay Applies Here Too

Regulation Z, at 12 CFR 1026.43, requires a lender to make a reasonable, good faith determination that you can repay the loan. There is no immigration carve-out in that rule. It applies to your file the same way it applies to everyone else's.

So treat any pitch built on skipping documentation as a warning. If someone offers financing with no income verification and no questions because of your status, you are looking at either a mispriced hard money loan or a lender who plans to make the file work by other means. Both are expensive.

A lender who will not tell you which investor buys your loan is telling you something.

Worth knowing your protections too. The Equal Credit Opportunity Act and the Fair Housing Act make national origin a protected class in mortgage lending. A lender may lawfully decline a loan because a program requires residency status you do not have. A lender may not treat you differently because of where you were born. Those are different things, and the second one is illegal.

The Miami Part Nobody Mentions: Your Tax Bill

Florida's homestead exemption removes a chunk of assessed value from your property tax bill and caps future assessment increases under Save Our Homes. Most ITIN buyers are told flatly that they do not qualify. The real answer is more interesting.

In Garcia v. Andonie, 101 So. 3d 339, decided October 4, 2012, the Florida Supreme Court considered a Miami-Dade condominium owned by Honduran citizens who held temporary visas. Their three minor children were U.S. citizens who lived in the property. The court read the Florida Constitution as granting the exemption where the owner maintains the permanent residence of the owner or of another legally or naturally dependent on the owner, and held that a statute narrowing that language could not stand against it.

This is fact-specific and it is not a general rule that visa holders get homestead. But it is a real pathway that gets overlooked, and it moves numbers. The exemption changes your escrow payment, escrow changes your debt-to-income ratio, and debt-to-income decides how much house the lender will approve. An ITIN Loan Is Not a Foreign National Loan

These get mixed up constantly and it costs borrowers money. A foreign national program is designed for someone who lives abroad, earns abroad and is buying here as an investment. Underwriting leans on foreign income, foreign assets and no U.S. credit, and it prices accordingly.

You live here. You work here. You file a U.S. return. That means U.S. pay stubs, U.S. bank statements and a U.S. payment history exist for your file, and those generally buy better terms and a smaller down payment than a true foreign national file gets. What to Have Ready Before You Call Anyone

  1. Your ITIN letter, plus confirmation the number has not expired
  2. Two years of filed federal tax returns showing the ITIN
  3. Two years of W-2s, or twelve to twenty-four months of business bank statements if you are self-employed
  4. Thirty days of recent pay stubs
  5. Two to three months of bank statements, with any large deposit already explained in writing
  6. Twelve months of documented rent and utility payments in your own name
  7. Valid photo identification, foreign passport or consular card included
  8. Any work authorization or status document you do have, because it may open a cheaper door than the one you were pointed at

That last item is the one people leave in a drawer. An employment authorization document or an approved petition can change which programs you are eligible for. Hand it over even if you assume it does not matter.

Should You Wait for a Social Security Number?

Usually no. Waiting on an immigration process with no defined end date, while Miami-Dade prices keep moving, is a bet most people lose. If an adjustment of status is weeks from completion and you already have a receipt notice in hand, sitting tight for a conventional or FHA option can be worth real money. Weeks, not someday.
